41-year-old Uber driver Muhammad Naveed who is accused of raping a female passenger and has pleaded not guilty to the charge of having had a sexual intercourse without consent told the court on Monday that the woman asked to have sex with him even as he protested.

reported that the accused who was present at NSW Court sobbed in court while giving evidence.

The Uber driver told the court that the woman had called him handsome, tried to kiss him and asked to have sex.

Mr Naveed sobbed and said, ‘she trapped me’.

"My hand was on top of my car gear stick and then she put her hand on top of my hand and she kept it there...She said 'thanks for giving me a ride you're a handsome man'," Mr Naveed said.

Mr Naveed told the court that she had tried to kiss him and he had protested saying that he had family.

He said that she suggested buying condoms.

"I said 'I don't know you, you don't know me, how I can trust you?'. Then she said 'we can get condoms'."

The court earlier heard that before driving in the opposite direction of woman's destination and stopping at a side street.

Crown Prosecutor James Trevallion had earlier told the court that the woman was heavily intoxicated, was falling asleep and could not keep her eyes open when the Uber driver stopped in a side street and asked if she wanted to move to the back seat.

The next thing the woman remembers is waking up to find Naveed on top of her.

‘She did not have the strength to be able to push him off,” Mr Trevallion .

Mr Naveed on Monday said that they did not have an intercourse as he could not get an erection.

He said the woman was "very angry" and called him a "dog".

Mr Naveed told the court that he then dropped her home, where she slammed the door and said "I'll never pay you".

Crown Prosecutor Trevallion told the court that upon reaching home, the woman phoned a friend, who called police.

The trial continues.
