Indian taxi driver avoids jail in fatal hit-and-run case

The judge held that Amarjot Singh Randhawa's act of driving while the victim was hanging on the car, was an act of 'momentary misjudgment'.

Amarjot Singh Randhawa has managed to avoid jail in a 2012 fatal hit-and-run case. A Sydney court today permitted Randhawa to serve out his term under an intensive corrections order, where jail time is served in the community with supervision and conditions such as community service.

Randhawa, a taxi driver, was found guilty in October last year of dangerous driving occasioning the death of 23-year-old Andrew Francis Heffernan.

Randhawa drover off his taxi while Mr. Heffernan was clinging to his vehicle. Mr. Heffernan fell off the taxi and died.

At the time of the incident, Randhawa was waiting at a taxi rank in Castle Hill when Mr Heffernan stood at the passenger window of the taxi, and fell down as the taxi moved ahead.

Randhawa who moved to Australia in 2008 was considered to be remorseful despite not pleading guilty.

Judge Gregory Farmer held that Randhawa's decision to drive off while Mr Heffernan was hanging on to the car was a case of "momentary misjudgment".
