On Friday Fairfax reported that it was possible the One Nation leader’s sister, Judy Smith, could replace Queensland Senator Roberts if he is found to be in breach of section 44 of the constitution.

The claims come after Senator Roberts said he had received confirmation of his renunciation of British citizenship on December 5, 2016 - months after the federal election.

He also insists he took appropriate steps with the British consulate in the months prior to receiving a formal reply.

Senator Roberts was urged to release evidence of his renunciation after claims he had travelled under a British passport as a child, and was listed on a registry of British nationals born overseas.

It’s reported the Turnbull government is looking into Senator Roberts’ eligibility and is considering referring the matter to the High Court.

If he is found to have been invalidly elected due to dual citizenship, his seat would go to the next in line, Fraser Anning.

However on Friday, Fairfax reported bankruptcy proceedings have been filed against . If Anning is the subject of those procceedings and they are successful, they could potentially rule him out also.

The constitution prevents people who are found to be bankrupt from serving in parliament.

There is no alleged wrong doing against Mr Anning as the bankruptcy application may not go ahead.

However, if it is found to be successful, Ms Smith would be next in line to represent One Nation in the upper house.

One Nation declined SBS World News request for comment on Judy Smith or Fraser Anning. Neither One Nation or Mr Anning has confirmed to SBS World News whether he is the subject of bankruptcy proceedings.

Senator Pauline Hanson has also been contacted for comment.
